OPTIMUM PEPTIDES, LLC — TERMS & CONDITIONS OF SALE AND USE
Last Updated: May 2026 | Governing Law: State of Montana
ALL products sold by Optimum Peptides, LLC ("Company," "we," "us") are intended EXCLUSIVELY for in vitro laboratory research, scientific study, analytical testing, and non-clinical investigational use by qualified professionals. These products are NOT approved by the U.S. Food and Drug Administration (FDA), the U.S. Drug Enforcement Administration (DEA), or any federal, state, or international regulatory authority for diagnostic, therapeutic, or other use in humans or animals. They are NOT drugs, dietary supplements, food additives, nutraceuticals, cosmetics, veterinary medicines, or household chemicals. ANY use outside of legitimate in vitro laboratory research is strictly prohibited and constitutes a material breach of these Terms.
By creating an account, placing an order, or completing any purchase, you expressly represent, warrant, and covenant — under penalty of account termination and legal liability — that each of the following is true and will remain true for the duration of your account:
(a) You are at least 21 years of age and legally competent to enter into binding contracts;
(b) You are a qualified researcher, licensed medical professional, licensed veterinarian, or duly authorized representative of an accredited research institution, university, pharmaceutical company, or clinical laboratory with appropriate expertise to handle, store, and work with research-grade chemical compounds;
(c) ALL products purchased will be used solely for lawful scientific research purposes in a properly equipped laboratory or clinical setting;
(d) Products will NOT be used for human consumption, self-administration, administration to another person, administration to animals outside of an approved and documented research protocol, or any non-research, recreational, or personal use whatsoever;
(e) You have independently verified that the purchase, possession, and intended use of these products is legal in your jurisdiction;
(f) You assume ALL risks — physical, legal, financial, and otherwise — associated with the handling, storage, transport, and use of these research compounds;
(g) All information provided during registration is accurate, complete, and not misleading. Fraudulent registration or misrepresentation of qualifications is grounds for immediate account termination and may be reported to relevant authorities.
The following uses are STRICTLY PROHIBITED and constitute a material breach of these Terms: (a) human consumption, ingestion, injection, topical application, or any form of self-administration; (b) administration to any other person; (c) administration to animals outside of a formally documented and institutionally approved research protocol; (d) resale, redistribution, or transfer to any person or entity that has not agreed to equivalent research-use restrictions; (e) use in any product intended for human or animal consumption; (f) use for any illegal purpose under federal, state, or local law; (g) circumvention of any age verification, eligibility, or compliance mechanism on this website.
Optimum Peptides reserves the right, in its sole and absolute discretion, to immediately suspend or permanently terminate your account and cancel any pending orders, without notice, refund, or liability, upon: (a) any violation or suspected violation of these Terms; (b) any indication of non-research use or intent to use products outside stated research purposes; (c) provision of false, misleading, or fraudulent registration information; (d) any chargeback, payment dispute, or fraudulent transaction; (e) any conduct that we determine, in our sole discretion, poses a legal, regulatory, or reputational risk to the Company. Termination does not limit any other rights or remedies available to the Company.
To the FULLEST EXTENT PERMITTED BY APPLICABLE LAW, you agree to INDEMNIFY, DEFEND (with counsel of the Company's choosing), and HOLD HARMLESS Optimum Peptides, LLC and its members, managers, officers, employees, agents, contractors, suppliers, successors, and assigns (collectively, "Indemnified Parties") from and against ANY AND ALL claims, demands, actions, proceedings, liabilities, damages, judgments, awards, losses, costs, expenses, fines, penalties, and attorneys' fees of any kind — whether brought by you, a third party, or a government entity — arising out of or relating to: (a) your breach of any representation, warranty, or covenant in these Terms; (b) your purchase, possession, handling, storage, transport, or use of any product; (c) your violation of any applicable law, regulation, ordinance, or third-party right; (d) any personal injury, death, illness, property damage, or other harm — to yourself or any third party — resulting directly or indirectly from your use of products outside their intended research application; (e) any false or misleading representation made during account registration or in connection with any order; (f) any claim that your use of our products violated any person's rights.
ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR RESEARCH PURPOSES ONLY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMUM PEPTIDES EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO WARRANTY THAT PRODUCTS ARE SUITABLE FOR ANY PARTICULAR RESEARCH APPLICATION, WILL PRODUCE ANY PARTICULAR RESULT, OR ARE FREE FROM CONTAMINATION. CERTIFICATES OF ANALYSIS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE A WARRANTY OF SUITABILITY FOR ANY USE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) OPTIMUM PEPTIDES' TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS, YOUR ACCOUNT, OR ANY PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; (b) IN NO EVENT SHALL OPTIMUM PEPTIDES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (c) THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ASSERTED, WHETHER CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS — IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
NOTHING on this website, in any communication from Optimum Peptides, or provided by our customer service (including our automated chatbot) constitutes medical advice, scientific advice, clinical guidance, diagnosis, treatment recommendation, or any form of professional consultation. No product description, specification, or Certificate of Analysis should be construed as a recommendation for use in humans or animals. Optimum Peptides is not a licensed medical provider, pharmacy, or clinical research organization. All research protocols, including dosing, administration methods, reconstitution procedures, and safety assessments, are solely the responsibility of the qualified researcher and their institution.
You are solely and exclusively responsible for: (a) determining the legal status of all products in your jurisdiction prior to purchase; (b) obtaining all permits, licenses, and approvals required for possession and use of research compounds in your jurisdiction; (c) ensuring full compliance with all applicable federal, state, local, and international laws and regulations, including but not limited to the Controlled Substances Act, DEA regulations, FDA regulations, and applicable state pharmaceutical laws; (d) proper handling, storage, disposal, and documentation of all research compounds in accordance with applicable safety and regulatory requirements. Optimum Peptides makes no representation that any product is legal, permissible, or appropriate for purchase or use in any particular jurisdiction.
Products are produced to research-grade purity standards. Third-party Certificates of Analysis (CoA) are available upon request. Due to the nature of research compounds and the necessity of maintaining cold-chain integrity, ALL SALES ARE FINAL. We will replace or issue store credit for products that: (a) arrive visibly damaged due to shipping; or (b) fail to meet the purity specifications stated on the CoA upon independent third-party verification. All claims must be submitted in writing within seven (7) days of confirmed delivery, accompanied by photographs and, where applicable, third-party laboratory analysis. We reserve the right to request the return of the challenged product before issuing any replacement or credit.
We collect your personal information — including name, contact information, shipping address, and purchase history — solely to fulfill orders, maintain your account, and comply with legal obligations. We do not sell, rent, or trade your personal information to third parties for marketing purposes. We may share your information with payment processors, shipping carriers, and service providers solely as necessary to complete your transaction. We implement commercially reasonable technical and administrative safeguards to protect your data. By creating an account, you consent to this data use.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms, any product, or your account — including questions of arbitrability — shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Lewis and Clark County, Montana. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED PROCEEDING, OR REPRESENTATIVE ACTION. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
These Terms shall be governed by and construed exclusively in accordance with the laws of the State of Montana, without regard to its conflict of law provisions. For any matter not subject to arbitration, you consent to the exclusive personal jurisdiction of the state and federal courts located in Lewis and Clark County, Montana, and waive any objection to venue in such courts.
Optimum Peptides reserves the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the website or placement of any order after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. For material changes, we will make reasonable efforts to notify registered account holders.
If any provision of these Terms is found invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with any order confirmation, constitute the entire agreement between you and Optimum Peptides concerning the subject matter hereof and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
By creating an account and placing any order, you acknowledge that you have read these Terms in their entirety, fully understand them, and irrevocably agree to be bound by them. If you do not agree to these Terms in full, you must not create an account or place any order.
